1. The website of Spoud AG / AGOORA.COM

1.1. Spoud AG, a Swiss-based company with registered seat in Berne, Switzerland (hereinafter “the Company”).

1.2 The protection of your personal data is important to the Company. The present privacy policy (“Privacy Policy”) describes the way the Company processes your personal data when you visit our websites (spoud.io and agoora.com) or when you use our application. In addition, the Privacy Policy stats your rights in respect with data protection.

1.3 Hosting services for our website is provided by Hostpoint AG in Switzerland, Applications are hosted on Amazon Webservices.

2. Personal data

2.1. The term personal data used herein applies to all personal information relating to an identified or identifiable person (“Personal Data”). This includes information such as title, name, gender, address, date of birth, e-mail address, telephone number, mobile number, IP address, payment details, and other information like the pages you looked at, the purchases made on our website and your reactions to offers displayed on our online services.

2.2 You can access to and browse on most areas of our IT-Platforms without having to provide personal details. However, the access to certain areas and functions of our IT-Platforms may require registration of certain Personal Data. Our web applications are mostly accessible by registration. By entering your Personal Data in the fields requested, you enable the Company to provide you with the services you select.

3.1 We collect your Personal data in order to provide you with the information you have requested, in particular information about us, our products and services and our business partners, provided that you agree to our contacting you.

3.2 We also collect your Personal Data to provide customer services and to respond to your inquiries and requests. In addition, we require the personal data for the personalization of customer communication, so that you can find offers that match your wishes and receive less advertising (by post or newsletter) overall.

4.1 The registration for our newsletter can be done in the section “Subscribe to newsletter”. Please enter your e-mail address in the field provided and then click on “OK”. You will receive a confirmation e-mail from us to the e-mail address you entered.

4.2 If you no longer wish to receive the newsletter, click on the “Unsubscribe” link at the bottom of a newsletter.

5. Cookies

Definition of cookies

5.1. On our websites, we use cookies. Cookies are small files that are saved on your computer or mobile device when you visit or use our IT-Platforms. Cookies save certain settings via your browser as well as data regarding information exchanged with the IT-Platforms via your browser.

5.2. Most of the cookies that we use are temporary, exist only while your browser is open and are deleted automatically once you close your browser. What kind of information is stored in cookies?

Which cookies do we use?

Technical Cookie: Technical cookies help to make our website usable by enabling basic functions such as page navigation and access to secure areas of the website. The website cannot function properly without these cookies.

6. Social Plugins

6.1 Our IT-Platforms use so-called social plug-ins of social networks such as Facebook, Twitter, Youtube, Google+, Pinterest or Instagram. Those social plug-ins are identifiable by their social network logos or by a like button.

6.2 If you call up our Internet pages that contain such a plugin, your browser establishes a direct connection with the provider’s computers. The content of the plugin is transmitted directly to your browser from the offering site and integrated into the website by the browser. By integrating the plugin, the provider receives the information that you have called up our website. If you are logged in to the provider at the same time, the provider can assign the visit to your profile. When you interact with the plugins – for example, by clicking the “Like” button or posting a comment – the relevant information is transmitted directly from your browser to the provider and stored there.

7. Log-Data

8.1 Without prejudice to the below Sections 8.2 to 8.4, we will only transfer your Personal Data to third parties if such recipient committed himself towards the Company to observe the applicable data protection laws.

8.2 Occasionally, we may also pass your details to our contractual partners to help us with any of our uses of your Personal Data set out in our Privacy Policy. For example, we may use third parties to complete and fulfill your orders, to assist us with delivering products to you, to finalize payment for ordered products or to help us collect payments from you, to analyze data and to provide us with marketing or customer service assistance.

9. Web Analysis Tools

9.1 The Company uses Google Analytics, a service provided by Google Inc. as a web analysis tool. This enables the use of our website to be analysed. Google uses cookies, which are stored on your device and allow an analysis of the website by you. The information generated about the use of our website, such as browser type, operating system used, referrer URL, IP address and time of the server request, is transferred to a server in the USA and is stored there. The transmitted IP address is not linked to other data from Google.

9.4 We use sentry.io to detect and record malfunctions of the website / web applications. In doing so, data on errors, together with your username, email address, IP address, your browser version and the software version used by us, are sent to the sentry service on a server in the USA. 9.5 We use fullstory.com to analyze the digital user experience of websites and web applications. Fullstory allows us to measure user interaction more accurately and understand the use of features better than Google Analytics does. The usage data together with usernames, email addresses, IP addresses, session duration and session frequency are sent to a server in the USA. 9.6 To control the available functions and settings of websites and web applications, we use split.io. Split.io allows us to make fine-granular settings that control which functions are made available to which users. 10. Links to Third Party Websites

10.1 Certain activities through the website may be linked with those from other unrelated third-party companies that offer you the option to share your Personal Data with the third party. Links provided on the IT-Platforms to third party platforms are provided as a convenience to you and we do not control those platforms or their privacy practices, which may differ from ours. We do not endorse or make any representations about any third-party platforms that may be accessible through the IT-Platforms.

10.2 External links on our website do not constitute an approval or assurance with regard to third party platforms. We, therefore, recommend that you check the privacy policies of the relevant third party companies before you submit your Personal Data.

11. Your Rights regarding your Personal Data

11.1. You have the right to receive information about your Personal Data processed by us in writing and free of charge at any time. We will delete your Personal Data as soon as they are no longer required and in any event after the maximum retention period required by law has expired.
